An inventory is a binding legal document, providing an accurate record of the condition and contents of a property at the beginning of a tenancy. It forms part of the Tenancy agreement between a landlord and tenant. All defects and soiling must be noted in detail in the inventory in order to ensure that a landlord is able to prove whether a tenant caused damage or is liable for cleaning costs.
The High Court in many recent cases has ruled that when letting agents have compiled an inventory for a landlord who employs them, a conflict of interest occurs; the Agent therefore, cannot be seen as independent, so rulings have generally been in favour of the Tennant.
As a result of this, it is now essential for Landlords and Agents to employ an Independent Inventory Clerk for the following reasons
